Draft for Australian legal review before public launch. Replace all square-bracket placeholders before publishing.

1. About these Terms

These Terms of Use (Terms) apply when you access or use LOKD money, including our mobile application, website and related services (together, the Service).

The Service is provided by [Company Legal Name] Pty Ltd (ABN [ABN]), trading as LOKD money ("we", "us" or "our").

By creating an account or using the Service, you agree to these Terms. Our Privacy Policy also applies.

2. What the Service does

LOKD money is designed to help users:

The current Service is an education, planning and behaviour-support tool.

Unless we expressly introduce a separately regulated feature:

3. Eligibility

You must be at least 15 years old to create a standard user account.

If you are under 18:

If you are an adult purchasing a subscription for a person under 18, you agree to the payment and subscription terms applying to that purchase.

We may use age bands or age-assurance tools to determine feature eligibility.

4. Your account

You must provide information that is accurate enough for us to provide the Service.

You are responsible for:

You must not allow another person to impersonate you or misuse your account.

5. General financial information — not personal advice

The Service provides general financial information, education, calculations and user-directed planning tools.

Unless we expressly tell you otherwise in relation to a separately regulated feature, nothing in the Service is intended to be:

We do not take into account your complete objectives, financial situation or needs.

You should consider your own circumstances and, where appropriate, seek advice from an appropriately qualified or licensed professional.

6. Payday Rules

A Payday Rule is a set of allocation preferences chosen or approved by the user.

For example, a user may choose to allocate portions of a pay event to NOW, NEXT, BUILD, FUTURE or other goals.

Payday Rules are planning instructions only in the current version of the Service. They do not cause real money to move between accounts unless we introduce a separate money-movement feature and you specifically activate it.

You remain responsible for deciding whether a Payday Rule suits your circumstances.

7. Projections and Future Me

The Service may show illustrative projections using assumptions such as contribution amounts, time periods and hypothetical rates of return.

These projections are examples only. They are not forecasts, guarantees or promises of future performance.

Actual investment returns, inflation, taxation, fees and personal circumstances may differ materially.

8. Investment education

The Service may explain concepts such as shares, ETFs, diversification, risk, compound growth and superannuation.

Educational content does not mean we recommend a particular investment or financial product.

Where specific financial products are offered in a future version, separate terms, disclosures, licences or partner arrangements may apply.

9. Payslips and automated extraction

You may be able to upload, share or forward payslips or similar documents.

We may use OCR, algorithms or AI to extract information. Automated extraction can be wrong. In the current app, a payslip photo is read on your device and deleted straight after, and only the figures you confirm are saved.

Where the Service asks you to confirm extracted information, you are responsible for checking it before confirming it.

Do not upload another person's payslip or private financial information unless you are authorised to do so.

10. AI features

The Service may include AI-assisted educational or support features.

AI output may be incomplete, outdated or inaccurate. Do not treat an AI response as personalised financial, investment, legal or tax advice or as a guarantee of financial outcomes.

Important decisions should be checked against reliable information or an appropriately qualified professional.

11. Coach features

A user may be able to invite a parent, guardian, mentor or other trusted adult as a Coach.

Coach access is limited by permissions available in the Service. Unless expressly enabled, a Coach should not receive detailed merchant-by-merchant spending or private transaction descriptions.

Users should only invite people they trust.

We may change Coach permissions as the product develops, but material changes to what a Coach can access should be clearly communicated.

12. Employer, school and sponsored access

An employer, school, TAFE, government program or other organisation may pay for or provide access to the Service.

Their sponsorship does not give them ownership of a user's account.

Unless clearly disclosed and lawfully authorised, a sponsor does not receive access to a user's detailed personal financial information.

We may provide sponsors with aggregate usage data, de-identified program metrics, entitlement information and limited administration information needed to operate the program.

13. Subscriptions

Some features may require a paid subscription. Available plans, prices and inclusions will be shown before purchase.

Depending on where you subscribe, payment may be processed by Apple, Google, our website payment provider or another approved billing provider.

13.1 Automatic renewal

If a subscription automatically renews, we will disclose the price, billing period, renewal arrangement, cancellation method and any trial conditions before purchase.

Unless cancelled in accordance with the applicable purchase terms, an automatically renewing subscription may renew for another billing period.

13.2 Cancelling

If you subscribed through Apple or Google, cancellation is generally managed through the relevant store account.

If you subscribed directly through our website, cancellation will be available through your account or the applicable billing process.

Cancelling normally stops future renewal. Access may continue until the end of the paid billing period.

13.3 Price changes

We may change subscription pricing. Where required, we will provide notice before a price change applies to an existing subscription.

13.4 Refunds and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

Any additional voluntary refund policy will be described separately.

14. Free trials and promotions

If we offer a trial or promotion, the conditions will be shown before activation.

Where a trial converts to a paid subscription, the conversion terms, price and cancellation method will be disclosed before the trial begins.

15. Notifications

You may choose to receive expected payday reminders, goal progress, learning prompts and other optional notifications.

You can control optional push notifications through the Service or device settings.

Operational, security or legal communications may still be sent where reasonably necessary.

16. Acceptable use

You must not:

17. Intellectual property

We or our licensors own the intellectual property in the Service, including software, design, branding, graphics, educational content, interfaces, documentation and proprietary calculation or rules systems.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal lawful use.

Nothing in these Terms transfers ownership of our intellectual property to you.

18. Your content

You retain ownership of information and content you submit to the Service.

You give us a limited licence to host, process, reproduce and use that content only as reasonably necessary to provide, secure, support and improve the Service in accordance with our Privacy Policy and to comply with law.

This licence ends when the content is deleted from our systems, subject to lawful retention, backups and other rights or obligations described in our Privacy Policy.

19. Feedback

If you voluntarily provide product ideas, suggestions or feedback, we may use that feedback to improve the Service without owing compensation, provided we do not use personal information inconsistently with our Privacy Policy.

20. Third-party services

The Service may integrate with or link to third-party services. Third-party services may have their own terms, privacy policies, fees, eligibility rules and availability.

We are not responsible for third-party services except to the extent required by law.

21. Service availability and changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable because of maintenance, outages, third-party failures, security issues, updates or circumstances outside our reasonable control.

We may add, change or remove features as the product develops. Where a change materially affects a paid service, we will provide notice where reasonably required.

22. Accuracy

We work to make calculations and information useful and accurate, but errors may occur.

Users should check important figures against authoritative sources such as a payslip, employer information, bank records, super fund records, Australian Taxation Office information or advice from an appropriately qualified professional.

23. Security

You must take reasonable steps to protect your account.

If you believe your account has been compromised, contact security@lokdmoney.com.

We may temporarily restrict access where reasonably necessary to protect an account, other users or the Service.

24. Suspending or closing accounts

You may close your account through the Service or by contacting us.

We may suspend or terminate access where reasonably necessary because of material breach of these Terms, fraud or suspected fraud, misuse, security risk, legal requirement or conduct that materially harms the Service or other users.

Where appropriate, we will try to provide notice and an opportunity to address the issue.

25. Liability

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the extent permitted by law, we are not responsible for losses caused solely by:

Any limitation applies only to the extent permitted by law.

26. Changes to these Terms

We may update these Terms as the Service develops.

If a change materially affects your rights or a paid subscription, we will provide reasonable notice and, where required, obtain agreement before the change applies.

The current version will show its effective date.

27. Governing law

These Terms are governed by the laws of South Australia, Australia.

You and we submit to courts having jurisdiction in South Australia and courts hearing appeals from them, subject to any rights you have under applicable consumer law to bring a claim elsewhere.
